Partner Visa (Offshore) — Subclass 309/100
If you're the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen and you're outside Australia, the offshore Partner visa lets you enter and remain in Australia with your partner. It begins with the provisional Subclass 309 visa and leads to permanent residence. We help you assemble the relationship evidence that gives your application its proper footing.
Who this visa is for
You generally need to show that:
- You're married to your partner, intend to marry before the visa is decided, or have been in a genuine de facto relationship (usually of at least 12 months)
- You and your partner are in a mutually exclusive, genuine and continuing relationship, and live together or apart only temporarily
- Your sponsor meets the sponsorship requirements, including police clearances and sponsorship-history limits
- You meet the health and character requirements
You must generally be outside Australia when the application is lodged.
How it works and next steps
We lodge your application with the Department on behalf of you and your sponsor. You may be asked to attend an interview or provide further checks. If successful, you're first granted the provisional Subclass 309 visa. Around two years after lodging, provided your relationship continues, you become eligible to submit the second-stage (Subclass 100) application with updated relationship evidence — a formal step we prepare and lodge for you.
Frequently asked questions
Can I visit Australia while the application is processing?
Often yes, on another visa such as a visitor visa — though your location at certain stages of processing matters. We plan your travel around the application, not the other way round.
What if we're engaged but not yet married?
The Prospective Marriage (Subclass 300) visa may suit — it lets you enter Australia to marry your partner, then apply for the partner visa onshore. We advise which sequence is right for your situation and budget.
Does evidence matter as much as for the onshore visa?
Yes — the relationship test is the same. Distance can make evidence-gathering harder, which is exactly why it should be planned deliberately from the start.
