Website Terms and Conditions
1. Acceptance of these Terms
By accessing or using this website (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site.
Where the Site enables you to make a payment, submit a booking, or lodge a form requiring you to actively confirm your agreement (for example, by ticking an "I agree" box), your acceptance of these Terms is confirmed at that point of active confirmation. For all other browsing use of the Site, your continued use constitutes acceptance of these Terms.
These Terms apply to your use of the Site only. They do not constitute, and must not be read as, a service agreement, retainer, or contract for the provision of immigration assistance. Any engagement of Visa & Migration Doctors to provide ongoing immigration assistance is governed exclusively by a separate written service agreement, entered into in accordance with s 42 of the Migration (Migration Agents Code of Conduct) Regulations 2021 (the "Code"). An initial consultation may be provided without a service agreement, as permitted by s 43 of the Code.
2. About us
Visa & Migration Doctors is a trading name of Students Avenue Pty Ltd. Immigration assistance through this practice is provided by Sunil Uprety, Registered Migration Agent (MARN 2318234), who is registered with the Office of the Migration Agents Registration Authority (OMARA) and bound by the Migration Agents Code of Conduct. You can verify this registration on the OMARA register at mara.gov.au.
3. General information only — no advice given via this website
The content on this Site — including articles, FAQs, visa information, and general guidance — is provided for general informational purposes only. It does not constitute immigration assistance, legal advice, or migration advice, and must not be relied upon as such.
Australian migration law and policy change frequently, and general information on this Site may not reflect your individual circumstances or the most current legislative position. No agent–client relationship is formed by your use of this Site, by browsing its content, or by submitting an enquiry or booking form. A client relationship is established only when we have agreed to act for you — through an initial consultation conducted under s 43 of the Code, or a signed service agreement for ongoing immigration assistance.
If you require advice about your specific circumstances, you should book a consultation.
4. Outcomes depend on individual circumstances
Any examples, reviews, or descriptions of matters on this Site reflect the individual circumstances of those matters. They are not a prediction or guarantee of the outcome of any other application. Visa and citizenship decisions are made by the Department of Home Affairs and review bodies, not by this practice, and no practitioner can guarantee a visa outcome.
5. Client reviews
Client reviews displayed on this Site are drawn from publicly available Google reviews via a third-party service. They are the authors' own words and reflect their individual experiences; they are not presented as a promise of any particular result.
6. Consumer Guide
The Consumer Guide for clients of registered migration agents, published by the OMARA, is available on this Site at [link to Consumer Guide page] and on request. Nothing in this clause affects our separate obligation under the Code to provide the Consumer Guide to clients directly.
7. Enquiries and initial contact
Submitting an enquiry through this Site (for example, via a contact form, booking tool, or client portal) does not create any obligation on our part to accept you as a client, and does not create a duty of care or confidentiality beyond what is reasonably necessary to respond to your enquiry and handle your information in accordance with our Privacy Policy. We reserve the right to decline to act for any prospective person at our discretion, subject to our professional and Code obligations.
8. Disclosure of interests
Students Avenue Pty Ltd may receive, or pay, a referral fee, commission, or other benefit in connection with referrals to or from third parties, including education providers and related professional service providers. Where such an arrangement is relevant to a specific matter, it will be separately disclosed to you in writing, in accordance with our obligations under the Code, before we act for you.
9. Intellectual property
All content on this Site — including text, graphics, logos, images, videos, and their arrangement — is owned by, or licensed to, Students Avenue Pty Ltd and is protected by Australian copyright and trademark law. You may view and print material from this Site for your personal, non-commercial use only. You must not reproduce, republish, distribute, modify, or create derivative works from any content on this Site without our prior written consent.
10. Acceptable use
You must not use this Site:
- for any unlawful purpose, or in a way that breaches any applicable law or regulation;
- to transmit or upload any virus, malware, or harmful code;
- to scrape, harvest, or extract data from the Site using automated tools without our consent;
- to impersonate any person, or misrepresent your affiliation with any person or entity; or
- in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of it.

11. Third-party links
This Site may contain links to third-party websites (for example, the Department of Home Affairs, the Administrative Review Tribunal, or the OMARA). These links are provided for convenience only. We do not endorse, and are not responsible for, the content, accuracy, or privacy practices of any third-party website, and your use of any such website is at your own risk and subject to that site's own terms.
12. Accuracy of information
We take reasonable care to ensure the information on this Site is accurate and current at the time of publication, and published pages carry a "Last reviewed" date. However, migration law and policy change frequently, and we do not warrant that all content is complete, accurate, or up to date at the time you access it. We recommend you confirm any information relevant to your circumstances directly with us before relying on it.
13. Limitation of liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted, or modified.
Subject to that, and to the maximum extent permitted by law:
- your use of this Site is at your own risk, and the Site is provided on an "as is" and "as available" basis;
- we exclude all implied warranties in relation to the Site and its content, to the extent permitted by law; and
- we are not liable for any indirect, consequential, or special loss arising from your use of, or inability to use, this Site, or your reliance on any general information published on it.
Nothing in this clause limits our liability arising from the provision of immigration assistance under an initial consultation or a signed service agreement — that liability, and any applicable limitations, is instead governed by the terms of the relevant engagement and our professional obligations under the Code. Nothing in this clause excludes liability for fraud or wilful misconduct.
14. Privacy
Our collection, use, and handling of personal information submitted through this Site (for example, via an enquiry, booking form, or client portal) is governed by our Privacy Policy, available at [link to Privacy Policy]. We may update these Terms from time to time, at our discretion, by publishing the updated version on this Site. Your continued use of the Site after any such update constitutes your acceptance of the revised Terms. We recommend you review these Terms periodically.
17. Governing law and jurisdiction
These Terms are governed by the laws of Western Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia, and any courts entitled to hear appeals from those courts, in respect of any dispute arising from these Terms or your use of this Site. Nothing in this clause affects the regulatory jurisdiction of the OMARA over the conduct of registered migration agents.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
